Terms of Service

These Terms of Service ("Terms") govern your access to and use of OniPay, an over-the-counter (OTC) platform for buying and selling USDT against Indian Rupees. By creating an account or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use OniPay. By registering, you confirm that the information you provide is accurate and that you are not barred from using virtual digital asset services under any law applicable to you.

2. Account & Identity Verification (KYC)

Every account must complete identity verification before placing any buy or sell order. Verification requires your full legal name, a working phone number, and your Aadhaar number together with a photo of your Aadhaar card and a selfie holding it. We may request additional information or documents at any time, including to investigate a specific transaction, and may pause your account until it is provided.

  • One account per person — accounts may not be shared, transferred, or opened using another person's identity.
  • Transaction limits scale with your verification tier and may be adjusted at our discretion.
  • We may reject, suspend, or terminate an account if verification cannot be completed or appears fraudulent.

3. Nature of the Service

OniPay facilitates OTC trades of USDT against INR. OniPay is not a bank and does not offer deposit insurance. USDT balances shown in your account are entries on OniPay's internal ledger, not funds held in a segregated trust or custodial account, unless stated otherwise at the time of a specific transaction.

4. Orders, Rates & Settlement

Rates displayed on the platform are set by OniPay and may change between the time you view a rate and the time your order is confirmed. Any applicable fees or spread are disclosed before you confirm an order. Orders are settled once payment and/or USDT transfer is verified on our end; settlement times may vary and are not guaranteed to be instant.

5. Prohibited Use

You may not use OniPay to:

  • Launder money, finance terrorism, or facilitate any other illegal activity.
  • Use a false identity or another person's documents.
  • Split or structure transactions to evade verification tiers or limits.
  • Interfere with, probe, or attempt to circumvent the platform's security controls.

We may report suspicious activity to the extent required or permitted by applicable law, and may freeze, reverse, or decline any order we reasonably believe to be connected with prohibited use.

6. Regulatory Status

OniPay is presented here for demonstration/illustrative purposes and is not currently registered with the Financial Intelligence Unit – India (FIU-IND) or any other financial regulator. Users should be aware that virtual digital asset services are subject to evolving legal and regulatory requirements in India and elsewhere, and should satisfy themselves of the legality of their use of the platform in their own jurisdiction. This section is not legal advice.

7. Liability

To the maximum extent permitted by law, OniPay is not liable for indirect, incidental, or consequential losses arising from your use of the platform, including losses caused by market volatility, delays in settlement, or actions taken to comply with our KYC/AML obligations.

8. Suspension & Termination

We may suspend or close your account, with or without notice, if we reasonably believe you have violated these Terms, provided false information, or if required to do so by law. You may close your account at any time by contacting support, subject to settlement of any open orders.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of OniPay after an update constitutes acceptance of the revised Terms.
